CLO Virtual Fashion, a prominent developer of 3D garment simulation software, has successfully concluded a patent infringement lawsuit against Zhejiang Lingdi Digital Technology, known for its Style3D platform. This settlement marks a significant moment in the digital fashion industry, underscoring the importance of intellectual property protection in a rapidly evolving technological landscape.

Resolution of the Patent Infringement Lawsuit

Zhejiang Lingdi Digital Technology, the entity behind Style3D, has formally acknowledged that its software infringed upon three specific patents held by CLO Virtual Fashion. This admission brings to an end a legal battle that commenced in 2023, focusing on advanced digital sewing and pattern-measurement technologies. CLO Virtual Fashion, a company with 15 years of experience in garment simulation, also confirmed that the patents it asserted are valid and enforceable. This agreement was reached outside of a courtroom verdict and concludes the case filed in the U.S. District Court for the Eastern District of Texas.

Uncertainties Surrounding the Settlement Details

Despite the resolution, the full implications of the settlement are not entirely clear. CLO Virtual Fashion has chosen not to disclose the financial terms of the agreement. Furthermore, it remains unknown whether the settlement involves any injunctions, licensing arrangements, or mandates for Linctex to alter or cease any functionalities within its Style3D Studio software. The announcement also does not specify which versions of Style3D Studio are covered by Linctex's admission of infringement, leaving open questions about the current iteration of the software.

The Timeline and Nature of the Legal Proceedings

Court records reveal that both parties jointly moved for dismissal of the case on February 19, following a settlement. CLO officially announced this resolution on August 25, more than six months after the initial dismissal request. The core of the dispute revolved around U.S. Patent Nos. 10,733,773; 11,410,355; and 11,222,448. The first two patents relate to tools for creating digital garments from 2D patterns, particularly those assisting designers in matching segment lengths for virtual sewing. The third patent focuses on measuring 2D patterns corresponding to simulated 3D clothing, emphasizing calculations from the flat pattern to avoid distortions from virtual draping.

Allegations of Broader Intellectual Property Misconduct

CLO's initial complaint painted a picture of a more extensive intellectual property conflict. The company alleged that Linctex had used over 50 unauthorized copies of CLO software, including within its research and development departments, to develop Style3D and replicate CLO's design features. While the source of this 50-copy estimate was not specified, the complaint cited a May 10, 2023 raid on Linctex's offices, authorized by a Chinese judge, to collect evidence related to the alleged unauthorized use. CLO filed its U.S. patent lawsuit approximately a month later. Additionally, CLO accused Linctex of improperly using one of its proprietary digital avatars for Style3D's marketing, an allegation presented as background information rather than a separate copyright claim in the U.S. lawsuit.

Judicial Rulings and Their Impact on the Settlement

The patent case involved several judicial decisions. On July 15, Judge Gilstrap rejected Linctex's attempt to invalidate certain claims of the '355 patent, ruling that they did not constitute an abstract idea. However, this ruling did not address the other two patents or all potential validity challenges. In a separate order on the same day, Gilstrap partially granted Linctex's motion for summary judgment, finding that "Subsequent Versions" of Style3D did not infringe the '355 patent or specific claims of the '773 patent. This order also limited CLO's pursuit of infringement under the doctrine of equivalents for certain claims. Furthermore, Magistrate Judge Roy Payne, in a July 6 order, excluded some CLO expert opinions due to untimely identification of an accused product. Ultimately, the comprehensive admission of patent validity and enforceability by Linctex stemmed from the negotiated settlement, not from these prior judicial findings.

Simon Kim, CEO of CLO, emphasized the company's long-standing commitment to innovation and the development of groundbreaking solutions that have transformed multiple industries. He stressed that protecting intellectual property is crucial not only for their business but also for preserving the value of innovative ideas. This sentiment aligns with a prior legal victory for CLO in China, where the Zhejiang Provincial High People's Court ruled that Linctex engaged in extensive commercial use of pirated CLO software, rejecting Linctex's fair-use defense. While the Chinese case focused on software copyright, the U.S. case centered on patent rights related to specific digital garment-design functionalities. Kim reiterated that in the current digital age, safeguarding the work of creators and inventors is essential for the healthy and sustainable growth of industries, reinforcing their dedication to this principle and their user community.

Future Implications for the Digital Apparel Industry

For apparel companies that leverage virtual design to streamline product development and reduce physical prototyping, a key question remains unanswered: does this settlement necessitate changes to currently available Style3D tools, or does it merely resolve issues pertaining to earlier software versions? Neither company has publicly addressed this ambiguity, leaving industry participants to ponder the practical impact of this resolution on their operational workflows and software choices
