Reports, including court documents reviewed by Reuters, indicate that board investigators successfully executed nine transactions via Kalshi's mobile platform while operating within Nevada's cellular networks. This occurred merely a day after the judicial deadline for Kalshi to implement a fully functional geofencing solution.

Kalshi's Defense: Collaboration and Communication

In its official communication, Kalshi clarified that it had engaged GeoComply, a vendor sanctioned by Nevada's gaming commission, at the state's own recommendation. The company emphasized its consistent communication and updates provided to the state throughout the process.

Allegations of Misrepresentation and Circumvention by Investigators

Kalshi's legal representatives contended that Nevada investigators had falsely declared their places of residence to Kalshi, thereby violating federal law. Furthermore, at least one investigator reportedly managed to bypass Kalshi's internal blocking mechanisms designed to enforce geofencing.

Judicial Injunction and Licensing Requirements

A judicial ruling in Nevada earlier in April had imposed a preliminary injunction, prohibiting Kalshi from offering its prediction contracts within the state without first securing a requisite gaming license.
