India Extends Tax Incentives, Boosting Apple's Manufacturing Presence

India has announced a significant policy shift, proposing to extend tax exemptions for foreign entities that provide equipment to contract manufacturers within its borders. This strategic move, which could last until 2041, is a major win for international technology giants, most notably Apple, which has been actively lobbying for such fiscal adjustments. The initiative underscores India's ambition to become a central hub for global manufacturing, diversifying the supply chain for high-tech products and fostering economic growth.

The South Asian nation's evolving economic landscape positions it as a crucial player in the global technology sector. For instance, Apple is rapidly expanding its iPhone production capabilities beyond China, with India projected to assemble a substantial portion of the world's iPhones by 2026. This trajectory reflects a broader trend of companies seeking to de-risk their manufacturing operations by establishing diversified bases. The proposed tax amendments aim to provide long-term certainty for these foreign investors, a critical factor in attracting sustained investment and deepening manufacturing ties.

Previously, India had introduced tax exemptions for foreign companies in February, set to expire in 2031. However, Apple had expressed concerns that India's tax framework might classify the machinery it supplies to its contract manufacturers as a 'business connection,' potentially subjecting its global iPhone profits to local taxation. The extension of these exemptions to 2041 directly addresses these fears, ensuring that companies like Apple can continue to invest and expand without adverse tax implications. This revised policy covers a wide range of electronic devices, including mobile phones, tablets, and wearable technology.

In addition to manufacturing equipment, the proposed legislation also extends tax relief to income earned by foreign companies from storing and supplying electronic components to contract manufacturers until 2041. This is particularly relevant for facilities located in customs-bonded areas, which are treated as outside India's customs territory. Such arrangements are highly attractive for export-oriented production, providing a favorable environment for global supply chain management and mitigating disruptions. Experts believe these changes will significantly enhance tax certainty and aid in building more resilient supply chains.

Furthermore, India is making strides to simplify tax exemptions for foreign companies utilizing data center services within the country. An earlier exemption, valid until 2047, sought to reassure global clients that their worldwide income would not be subject to Indian taxes merely for using local data facilities. The latest proposal streamlines this by allowing data centers to be leased rather than requiring outright ownership by Indian partners. This flexibility is expected to lower capital expenditure for international firms and open doors for smaller and medium-sized enterprises to enter the market, thereby fostering a more dynamic digital infrastructure ecosystem.

The Indian government's proactive measures, including a 15-year tax exemption for foreign diamond miners and traders operating in designated trading zones, highlight a comprehensive strategy to boost various sectors of its economy. These fiscal incentives collectively aim to enhance India's competitiveness on the global stage, making it an increasingly attractive destination for foreign direct investment and advanced manufacturing. By creating a stable and predictable tax environment, India seeks to embed itself deeper into global value chains and stimulate long-term economic prosperity.
